This Website Privacy Statement explains Cellsense’s policies and practices in relation to the handling of personal information that may be collected through this website. The terms of this Website Privacy Statement are subject to any specific provisions dealing with privacy that may be contained in the terms and conditions for particular offers, products and services made available through this website. Collection of personal information through this website

The type of personal information that Cellsense collects about you depends on how you use this website. For example, personal information will be collected when you enter it in the “Contact Cellsense” form. We may also keep records of any emails or other correspondence that you send to us through the website.

Collection of information other than personal information

Some of the information that is collected about your visit to the Cellsense website is not personal information, because it does not reveal your identity. For example:

•    Site visit information - When you visit the Cellsense website, general information is  collected about your visit, including your server address, the date and time of your visit, the pages accessed, the information downloaded and the type of browser you used.

This information is used by Cellsense in anonymous, aggregated form, for statistical purposes and to assist us to improve the functionality and usability of the site. You are not individually identified.
Use and disclosure of personal information collected through this website

Cellsense may use and disclose personal information collected on this website for the purpose for which it was collected (the “primary purpose”). For example, if you send us a query, we will use your personal information to respond to that query. If you make any comments about our products or services (including this website), we may use that information to develop and improve those products and services.

If we use or disclose your personal information for a purpose other than the primary purpose (the “secondary purpose”), to the extent required by the Privacy Act we will ensure that:

•    the secondary purpose is related to the primary purpose of collection (and directly    related in the case of sensitive information), and you would reasonably expect that Cellsense would use or disclose your personal information in that way; or
•    you have consented to the use or disclosure of your personal information for the secondary purpose (we may obtain that consent at the time of collection); or
•    the use or disclosure is required or authorised by or under law; or the use or disclosure is otherwise permitted by the Privacy Act 1988 (Cth) (for example, as a necessary part of an investigation of suspected unlawful activity).

We may also disclose your information to organisations involved in a proposed or actual transfer or sale of all or part of the business or assets of Cellsense business.
Access to information collected through this website

Please contact Cellsense if you would like to access or correct the personal information that we hold about you. Cellsense will generally provide you with access to your personal information if practicable (although a fee may be imposed), and will take reasonable steps to amend any personal information that is incorrect. In some circumstances though, Cellsense may not permit access to your personal information, or may refuse to correct your personal information, in which case we will provide you with reasons for this decision.


Collection of personal information from third party web pages

Some of the pages of the Cellsense website are hosted by third parties. If personal information is collected from one of those pages and provided to Cellsense, we will treat that information in accordance with this Privacy Statement, as though it was collected directly by Cellsense. However, Cellsense is not responsible for the use by those third parties of the information that they collect.

The Cellsense website also contains links to third party websites that are not operated or controlled by Cellsense parties. Please note that Cellsense is not responsible for the privacy or security practices of those websites and that those sites are not covered by this Privacy Statement. Third party websites should have their own privacy and security policies, which we encourage you to read.

Website security

The Cellsense network is designed to separate the database server, where all the information is stored, from the internet as much as possible. The website is protected by a firewall which performs stateful packet inspection.

If you are at all concerned about sending information over the Internet, you can contact us by post or facsimile. Our details are set out below.

Any personal information that Cellsense holds about you in our computer systems is protected externally from unauthorised access by a secure firewall and internally by restricted username and password control. You can also help to protect the privacy of your personal information by keeping your password secret (if applicable) and by ensuring that you log out of the site when you have finished using it. In addition, if you become aware of any security breach, please let us know as soon as possible.

We may amend this Privacy Statement from time to time by posting the amended version on this website.

Cellsense Privacy Policy
This Privacy Policy explains how Cellsense manages the personal information that we collect, use and disclose and how to contact us if you have any further queries about our management of your personal information.

This Privacy Policy does not cover personal information collected or held by Cellsense about its employees.

Background


Since 2003, Cellsense has been required by the Privacy Act 1988 (Cth) (the “Privacy Act”) to comply with ten National Privacy Principles ("NPPs") in accordance with the provisions of the Privacy Act.

The NPPs regulate the manner in which personal information is handled throughout its life cycle, from collection to use and disclosure, storage, accessibility and disposal.

Personal information is information or an opinion, in any form and whether true or not, about an individual whose identity is apparent or can reasonably be ascertained from the information or opinion.

Special provisions apply to the collection of personal information which is sensitive information. This includes health information (which is itself defined in the Privacy Act) and information about a persons' race, ethnic origin, political opinions, membership of political, professional or trade associations, religious or philosophical beliefs, sexual preferences and criminal history.

Collection of personal information by Cellsense

To the extent required by the Privacy Act:

•     Cellsense will not collect personal information about you unless that information is necessary for one or more of our functions or activities.
•     Cellsense will collect personal information only by lawful and fair means and not in an unreasonably intrusive manner.
•     Cellsense will not collect sensitive information (such as health information) about you without your consent, unless that collection is otherwise permitted by the Privacy Act;
•     When Cellsense collects personal information directly from you, we will take reasonable steps at or before the time of collection to ensure that you are aware of certain key matters, such as the purposes for which we are collecting the information, the organisations (or types of organisations) to which we would normally disclose information of that kind, the fact that you are able to access the information and how to contact us (for example, where personal information is collected on a form, we will generally include a written privacy  statement on the form which sets out these details);
•     Cellsense will collect your personal information directly from you where it is reasonable andpracticable to do so. Where Cellsense collects information about you from a third party, we will still take reasonable steps to ensure that you are made aware of the details set out above.

Use and disclosure of personal information by Cellsense

If Cellsense uses or discloses your personal information for a purpose (the “secondary purpose”) other the main reason for which it was originally collected (the “primary purpose”), to the extent required by the Privacy Act, we will ensure that:
•     the secondary purpose is related to the primary purpose of collection (and directly related in the case of sensitive information, such as health information), and you would reasonably expect that Cellsense would use or disclose your personal information in that way; or
•     you have consented to the use or disclosure of your personal information for the secondary purpose; or
•     the use or disclosure is required or authorised by or under law; or
•     the use or disclosure is otherwise permitted by the Privacy Act (for example, as a necessary part of an investigation of suspected unlawful activity).

We may also disclose your personal information in the case of a sale of the Cellsense business (in whole or part), to the purchaser (as an asset of the business).

Data quality and security

To the extent required by the Privacy Act, Cellsense will take reasonable steps to:

•     make sure that the personal information that we collect, use and disclose is accurate, complete and up to date;
•     protect the personal information that we hold from misuse and loss and from unauthorised access, modification or disclosure; and
•     destroy or permanently de-identify personal information that is no longer needed for any purpose that is permitted by the Privacy Act.
   
You can help Cellsense to keep the personal information that we hold accurate, complete and up to date, by letting us know about any changes to your personal information, such as your name and address.

Anonymity
Cellsense will provide individuals with the option of not identifying themselves when entering transactions when it is lawful and practicable to do so. However, in many cases Cellsense will not be able to provide this option, as we must collect identifying information to provide services such as cord blood storage.

Use of Commonwealth government identifiers

Cellsense will not use Commonwealth government identifiers (“Identifiers”) (such as Medicare numbers) as its own identifier of individuals. We will only use or disclose Identifiers in the circumstances permitted by the Privacy Act.

Transfer of personal information overseas

If Cellsense transfers your personal information outside Australia, we will comply with requirements of the Privacy Act that relate to transborder data flows.

Access and correction of your personal information

Please contact Cellsense if you would like to access or correct the personal information that we hold about you.

Cellsense will generally provide you with access to your personal information if practicable (although a fee may be imposed), and will take reasonable steps to amend any personal information that is incorrect. Complaints

Please contact the Cellsense Operations Manager using the above details if you have any concerns or complaints about the manner in which your personal information has been collected or handled by Cellsense.

Cellsense may change this Privacy Policy from time to time.  Any changes will be published on this website.
